Abstract

The purpose of this research is to analyze and determine which guarantees that are part of the due process recognized in the Chilean constitutional system, should be applied to the sanctioning administrative procedure. For this, a particularized examination is made in relation to the application to this procedure of the right to be heard; the right to a decision within a reasonable time; the right to an independent and impartial tribunal; of the right to a natural judge; of the right to the presumption of innocence; of the right of defense; ne bis in idem and the right to a public trial.
